The Central Government has notified the Animal Birth Control Rules, 2023 vide G.S.R 193(E) dated 10th March, 2023 under the Prevention of Cruelty to Animal Act, 1960 and after superseding the Animal Birth Control (Dog) Rules, 2001.
1. Section 321 (BNS) - Cruelty to Animals-Replaces IPC Section 428 & 429
2. Section 322 (BNS) - Killing or Maiming Animals- Replaces IPC Section 428 & 429
3. Section 323 (BNS) - Poisoning Animals- Replaces IPC Section 277 & 328
4. Section 324 (BNS) - Animal Fights and Related Activities- Replaces IPC Section 11
(Prevention of Cruelty to Animals Act) in organizing or participating in animal fights, addressing a critical gap in the IPC.
5. Section 325 (BNS) - Neglect of Animals- New Provision
- This section is a new addition that addresses the neglect of animals, covering areas such as failure to provide adequate food, water, and shelter.
ABC RULES 2022 - have been notified by the government. It's a great victory for dogs, cats and their feeders.
- ABC Rules 2022 is a law that is now a part of the constitution and cannot be challenged, amended, changed or denied by any government, non-govt Dept, WA, Police and even courts.
- The Hon'ble courts of India will also direct any further action based on these and these alone.
- If anyone violates these they commit a crime and can be taken to court for action for which the courts will only and only ask ABC Rules 2022 to be upheld.
- All other state Acts & Laws stand null and void.
So now what do the new ABC rules have in store for us?
- Feeding cats and dogs is a law now. If anyone stops you from feeding then they are going against the law.
- No courts can now order No Feeding.
- RWAs are now responsible for ensuring the feeding of cats and dogs.
- The current controversy about the dogs and cats should be fed now stands settled as per law.
- More power has been given to animal caregivers. Read in detail inside the document.
- Of course there is some responsibility attached also, but manageable. In case of disputes, there is support from AWOs and NGOs that you can seek which was not the case before. So AWOs have also been given legal power indirectly to assist feeders.
- Now feeders can openly and legally participate in ABC programs and the malpractices in certain cities where ABC is a scam can be stopped at their level as they have been given powers to participate in a transparent ABC process.
- There is no provision for AGGRESSIVE OR NUISANCE dogs so they cant be impounded or picked up or housed in shelters permanently. So Noida pounds by authority for eg is now illegal and can be shut if taken up legally in the lower court. Courts can't change ABC rules.
